IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE OR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO ANTHONY'S COAL FIRED PIZZA IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

THE LIMITATIONS OF LIABILITY SET FORTH HEREIN ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN ANTHONY'S COAL FIRED PIZZA AND YOU. SOME STATES DO NOT ALLOW LIMITATIONS OF LIABILITY FOR CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY.

10. Indemnification

You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza and its officers, directors, employees, agents, licensors, service providers, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

Subject to the dispute resolution provisions in Section 12 below, you agree that any legal action or proceeding arising out of or relating to these Terms or the use of the Website shall be brought exclusively in the federal or state courts of competent jurisdiction located in the United States, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

Federal consumer protection laws, including the Federal Trade Commission Act (15 U.S.C. § 45 et seq.), may apply to your use of our services. 12. Dispute Resolution

12.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to contact Anthony's Coal Fired Pizza by email at [email protected] and provide a written description of your dispute, the relief you seek, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If we are unable to resolve the dispute informally, either party may proceed with formal dispute resolution as set forth below.

12.2 Binding Arbitration

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE WEBSITE OR OUR SERVICES — INCLUDING QUESTIONS OF ARBITRABILITY — SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, AS AMENDED FROM TIME TO TIME. THE ARBITRATOR'S DECISION SHALL BE FINAL AND BINDING AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION.

The arbitration shall be conducted in the English language. The arbitrator shall have authority to award any remedy available under applicable law. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration agreement.

12.3 Class Action Waiver

YOU AND ANTHONY'S COAL FIRED PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST ANTHONY'S COAL FIRED PIZZA. If a court or arbitrator determines that the class action waiver is unenforceable, then the arbitration agreement shall be null and void as to that proceeding.

12.4 Jury Trial Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AND ANTHONY'S COAL FIRED PIZZA BOTH WAIVE THE RIGHT TO A TRIAL BY JURY WITH RESPECT TO ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE OR SERVICES.

13. Term and Termination

These Terms shall remain in full force and effect for as long as you access or use our Website or services. Anthony's Coal Fired Pizza may, in its sole discretion, terminate or suspend your access to all or any portion of our Website and services at any time, with or without notice, and with or without cause, including but not limited to your violation of these Terms.

A waiver of any default, breach, or right shall not constitute a waiver of any subsequent default, breach, or right.
